1. Sweepstakes Description/Eligibility: No purchase necessary.
No purchase necessary. This promotion is available only to residents within the 48 continental United States and the District of Columbia. Entrants must be at least 18 years of age. Void where prohibited by law. Employees of Sponsor, any of their advertising or promotional agencies, any sponsor of any prize offered in this sweepstakes or any business or entity involved in the development, production, implementation, administration or fulfillment of this sweepstakes, and their immediate family members (spouses, parents, siblings and children living in the same household) are not eligible to win. Contest begins January 1, 2009 at 12:00am and ends February 28, 2009 at 11:59pm. Entries must be received within this time frame to be considered eligible.
2. How to Enter:
Members of healthybalance.com will automatically be entered into sweepstakes. Non-members may enter by mail, without purchase or obligation, by sending a 3×5 inch postcard, handwritten with the following information: first and last name, address, date of birth, and a telephone number where you can be reached. Mail-in entries must be received by February 28, 2009. Mail entries should be addressed to:

Limit one entry per person. Duplicate entries may result in disqualification of entrant. Lost, damaged, illegible, or incomplete entries will be considered void. Completed entries become property of Sponsor, and will not be returned. Sponsor may collect personal data received from information given via sweepstakes entries and may use this information for future promotions. Please review our privacy policy.
By entering the sweepstakes, you agree to the terms and conditions of the privacy policy and agree to be bound by the rules of this sweepstakes. 3. Prize/Winner Selection and Notification:
One prize will be awarded. Prize will consist of one Ektelon O3 racquet, and a set of 3 racquetballs. Prize will be shipped to the winner’s home. Approximate retail value: $295. In the event that this particular prize is not available, Sponsor has the right to substitute a comparable prize in its place, of equal or greater value. A random drawing will be conducted by Sponsor by March 10, 2009 to determine sweepstakes winner. Winner will be notified by phone or e-mail. Three attempts will be made to contact winner. If winner cannot be reached in three attempts and/or within seven days, this person may be disqualified. In the event that the originally selected winner is disqualified for any reason, another winner will be randomly chosen from the remaining entries. Odds of winning approximately 1 in 40,000, depending on number of entries.
4. Prize Acceptance:
Prize will be awarded within sixty days after winner has verified identification and eligibility. Acceptance of the prize constitutes permission for Sponsor to use winner’s name, hometown, likeness, photograph, statements or prize information for advertising and publicity purposes without limitation and without additional compensation, except where prohibited by law.
5. Other Terms and Conditions:
BY ACCEPTING THE PRIZE, WINNER AGREES THAT THE SPONSOR, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR’S EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS, OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY.
